Valuation in divorce cases

In a marital dissolution, one of the assets included in the marital estate can be a closely held business. Depending on the couple’s prenuptial agreement or community property rules, a business or portfolio of shares could be considered marital property. There may be settlement provisions that have been agreed, which means the operating profits must be distributed equitably among the two spouses.
